1. INTRODUCTION & ENTITY DISCLOSURE
These Terms and Conditions (“Terms”) govern your access to and use of the LeadSifter web‑based platform (“Platform”), including all lead‑generation, distribution, analytics, software, services, communication tools, and marketplace features (“Services”). Leads (“leads”) refer to consumer inquiries or requests for information collected, processed and distributed through LeadSifter.
LeadSifter (“we” or “us”) is a proprietary software product owned, operated, and legally controlled by Infinite Insight, LLC, a Michigan‑registered Limited Liability Company.
By accessing or using the Platform, the User (“User,” “Agent,”“You,” or “Agency”) acknowledge that You have read, understood, and agree to be bound by these Terms & Conditions Agreement (“Agreement”). If you do not agree, you must discontinue use.
These Terms work together with:
- Privacy Policy
- Cookie Policy
- User License Agreement (ULA)
- Data Processing Agreement (DPA)
- Compliance Page (forthcoming)
All of these documents collectively form the legal framework for using LeadSifter and apply simultaneously.
2. ELIGIBILITY
To use LeadSifter, you must:
- Be at least 18 years old;
- Hold required insurance licenses or certifications (where applicable);
- Provide accurate registration information;
- Use the Platform only for lawful, compliant insurance marketing;
- Have an active Platform account in good standing;
- Agree to all compliance and privacy obligations.
LeadSifter may verify license status and reserves the right to deny or terminate access at its discretion.
3. LICENSE GRANT
Infinite Insight, LLC grants you a limited, revocable, non‑exclusive, non‑transferable license to access and use the Platform exclusively for lawful insurance prospecting and consumer outreach activities. You are permitted to resell leads within the Platform, purchase exclusivity, preview leads, access data analytics or utilize CRM systems. Any other uses, including those prohibited by federal or state telemarketing, privacy, or data‑use law, are strictly forbidden.
Nothing in these Terms transfers any ownership rights of LeadSifter, source code, intellectual property, derivative rights or its underlying assets from Infinite Insight, LLC to any User.
4. PROHIBITED USES
You may NOT:
A. Misuse Data
- Sell, share, or export leads outside permitted Platform workflows
- Retain consumer data for unrelated marketing
- Store leads without proper security safeguards
- Contact consumers without appropriate consent
B. Violate Compliance Laws
You must NOT violate:
- TCPA
- National Do Not Call (DNC) rules
- FCC/FTC telemarketing regulations
- CMS Medicare marketing guidelines (if applicable)
- Any state‑level outreach laws
C. Abuse Platform Functions
- Circumvent exclusivity timers
- Attempt to bypass preview fees
- Interfere with data processing
- Reverse engineer or extract Platform code
- Use bots, automation, or web‑scraping tools
- Engage in fraud, harassment, or misrepresentation
Violations may result in immediate suspension or termination and referral to relevant authorities.
5. PLATFORM FEATURES & DISCLAIMERS
Lead Previews
Limited consumer data provided for initial outreach attempts.
Exclusivity Holds
Three (3) business days after a User initiates contact.
Exclusive Purchases
Users may purchase exclusive rights to a lead, removing the lead from the marketplace.
Resale Marketplace
Lead resale must follow Platform rules and data integrity controls.
No Guarantees
LeadSifter is provided on an “as‑is” and “as‑available” basis. We do not guarantee:
- Contact rates
- Conversion rates
- Lead quality
- Lead responsiveness
- Profitability or revenue outcomes
- Performance outcomes
- Platform uptime
- Third-party service stability
Scheduled maintenance or outages may occur at any time. (See General Disclaimer in Section 14.)
6. PAYMENT & BILLING
- All fees musts be paid in accordance with the pricing and billing terms agreed upon at purchase
- All fees are non‑refundable unless explicitly stated
- Includes previews, exclusivity purchases, subscriptions, resale fees, or marketplace transactions
- Chargebacks may result in account suspension
- Subscriptions renew automatically unless canceled in advance, including one-time transactions, recurring subscriptions and any applicable processing fees
- You are responsible for taxes, surcharges, or payment method issues

7. DATA USE & PRIVACY (INCLUDES GDPR)
Your use of the Platform is subject to the Privacy Policy, Cookie Policy, and Data Processing Agreement (DPA).
A. User Responsibilities
You must:
- Protect consumer data
- Maintain call logs, consent records, opt‑out logs and compliance events
- Store data securely
- Prevent unauthorized access
- Comply with all federal & state privacy laws
B. LeadSifter’s Processing Role
Infinite Insight, LLC acts as:
- Data Processor for agency-conducted outreach
- Data Controller for Platform operation and data integrity
C. GDPR — EU USERS & VISITORS
While LeadSifter is intended for U.S.-based insurance operations:
EU/EEA visitors have rights under GDPR, including:
- Access
- Correction
- Deletion (“right to be forgotten”)
- Data portability
- Objection to processing
- Restriction of processing

If a User processes the personal data of individuals located in the EU/EEA, the User acts as a data controller, and Infinite Insight, LLC acts as a data processor solely to the extent required to operate the LeadSifter Platform. Users are responsible for establishing a lawful basis for processing consumer data, honoring access/deletion requests, and maintaining records of legitimate interest or consent where required.
Infinite Insight will only process EU/EEA consumer data for Platform functionality, security, analytics, or compliance operations.
LeadSifter uses Standard Contractual Clauses (SCCs) when applicable.
8. CALIFORNIA PRIVACY (CCPA/CPRA)
If you are a California resident, you have rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):
You may request:
- What data we collect
- How it is used
- Correction
- Deletion
- Opt‑out of “sale” or “sharing”
LeadSifter does not sell consumer data outside the internal controlled marketplace.

9. INTELLECTUAL PROPERTY
All materials on the Platform – including source code, trademarks, algorithms, workflows, databases, branding, UI/UX, documents, software, digital assets, Platform content and internal methodologies belong exclusively to Infinite Insight, LLC.
Users receive no ownership, equity, IP rights, or derivative rights by using the Platform.
10. ACCOUNT SECURITY
You may be required to create an account. You agree to provide accurate information and are responsible for all activity under your account, including:
- Maintaining account confidentiality
- Preventing unauthorized access
- Not sharing login credentials
- Reporting suspicious activity immediately
11. TERMINATION
Infinite Insight, LLC may suspend or terminate access for:
- Policy violations
- Non-payment
- Data misuse
- Fraud, abuse or harmful conduct
- Regulatory non‑compliance
Users may terminate accounts at any time, but all outstanding balances remain due. Upon termination, your right to access the Platform ceases immediately.
12. CONFIDENTIALITY & NON‑DISCLOSURE
Users agree to keep confidential:
- LeadSifter pricing
- Proprietary workflows
- Internal processes
- Lead sources
- Algorithms
- Consumer data
- Operational structures
- Exclusivity systems
- Marketplace logic
Unauthorized disclosure constitutes grounds for immediate removal and possible legal action.
13. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Infinite Insight, LLC is not liable for:
- Lost income
- Loss of business
- Indirect or consequential damages
- User misuse of consumer data
- Regulatory violations caused by Users
- Errors from third‑party systems
- Platform downtime or interruptions
Maximum aggregate liability shall not exceed the total amount paid by the User within the preceding 12 months.
14. INDEMNIFICATION
You agree to indemnify and hold harmless Infinite Insight, LLC and its officers, employees, contractors, and affiliates from any claims arising from:
- Violation of telemarketing laws
- Improper use of consumer data
- Misrepresentations made to consumers
- Unauthorized resale or distribution of Leads
- Breach of these Terms or the ULA
15. GENERAL DISCLAIMER
LeadSifter provides data management tools, compliance support features, marketplace functionality and filtering mechanisms; however, Users remain solely responsible for complying with all federal, state, local, and carrier-level regulations, including but not limited to TCPA, DNC, FCC, FTC, CMS, and relevant data-privacy laws.
We do not:
- Guarantee lead validity
- Guarantee consumer responsiveness
- Guarantee revenue outcomes
- Verify accuracy of consumer-submitted data
- Enforce legal compliance on behalf of Users
- Guarantee legal outcomes
- Guarantee regulatory approval
- Guarantee risk elimination
Users accept full responsibility for their outreach activities and regulatory compliance.
16. MODIFICATIONS
Infinite Insight, LLC reserves the right to update, modify, or revise these Terms at any time. Updated Terms are effective immediately upon posting. Continued use of the Platform constitutes acceptance of the revised Terms.
17. GOVERNING LAW
These Terms are governed by the laws of the State of Michigan.
